The Commission of integrity has proposed a draft law to amend the current criminal procedures law No.23 of 1971. The proposed law states no person shall be arrested or detained, unless there is sufficient evidence indicates crime committed.
Originally, the draft law is requiring the suspected under investigation to appear in the court of law, by notifying the accused with summon, except those charged with crimes of life sentence or 25-life sentence and death penalty. The current law requires no evidence, in which may be resulted in detaining innocents and violation of human rights.
The reasons stood behind the amendment were to protect the individuals from abusive investigative measures that lack evidence. The draft law was prepared by the Commissioner of Integrity, assigned by the Vice-President, Dr. Adel Abed AlMehdi. The draft has submitted to the parliament pending legislative, pursuant to article 61/1of the Iraqi constitution.
