A survey team from CoI’s Prevention Office recommended to form a central committee in each branch of the General Directorate of Real Estate Registration in accordance with the applicable regulations, to settel the issue of the reserved files that have a reservation in each branch of the General Directorate of Real Estate Registration due to the lack of an appropriate database with respect to owners, reservations and registration restrictions because the used systems are very old.
The team, which made field visits to the General Directorate of Real Estate Registration and some of its branches in Baghdad governorate, monitored some files reserved in safes of some directors of real estate registration, as in the Real Estate Registration Directorate (Rusafa 1 and 2) . The team mentioned the existence of repeated mistakes, in accuracies in recording and auditing petitions concerning number of shares and name of owner of the property, where the employees eliminate the incorrectly written names or shares without a correction petition as well as the existence of petitions not audited for several months. The team pointed out that some members of audit committees are not competent and did not practice audit work.
In its report, of which a photocopy was sent to the office of Minister of Justice, the team indicated the difficulty to identity the deficient employee in case of losing file or violating regularities. It mentioned that some directors reserved petitions without writing the reason as well as delays in the completion of real estate petitions because of separating Al-Karkh registration office into two directorates (first and second), which led to loss files and records.
The team called for the formation of a higher central committee to review the subject of leased buildings to the real estate registration departments and to find out the real reasons for the delays in some projects for legal comple xes that reached advanced stages of building. The total amount spent on rent buildings for the years 2008-2017 is about four Billion dinars, while the amount owed as rental for the years (2016-2017) about one billion dinars, note that most of these buildings are old.
The report suggested to maintain records and damaged files by archiving them electronically in a proper manner and to work hard to archive all the files in the public real estate registry departments, with providing appropriate places, where there are files dating back to 1920 and most of these files are subject to damage and extinction, using cameras system in all public real estate registration departments, assigning competent officer to monitor and keep all information related to cameras for reviewing it in case of losing files or violations.
