Since its establishment in 2004 , CoI has been taking over the task of combating all types of corruption in government offices and joint sector institutions, working on creating transparency atmosphere in the public life and insuring subjective conditions for the employees to perform their duties efficiently and sincerely. It also protects them, from abusing their authorities, guarantee specialization principal and undertake responsibilities. The administrative structure of CoI consists of nine directorates including prevention office responsible to protect CoI employees on different levels from corruption and abuse their authorities that cause damages to the country and people, or utilize their official authorities to get illicit personal benefits by bribery or embezzlement.
The administrative structure of prevention office consists of six divisions and sections as the following: Secretary, Administration section, Following up and planning, Anti-bribery, Financial disclosure and Transparency.
It is important here to focus on the responsibilities of the last three directorates mentioned above as they are in charge of the preventive task of CoI while the other three directorates are responsible for the administrative and functional support.
1. Anti-bribery directorate:
The main task of this directorate is to eliminate the bribery phenomena by implementing the strategy of the national anti–corruption campaign and that will be achieved by conducting surveys in different governmental institutions dealing with people services in order to exam the level of bribery.
When the survey teams accomplish their work, the Statistic section study and analyze the outputs and results that given by people in the questionnaire forms and determine the accurate indicators the reasons behind paying bribes in the targeted offices and then give suggestions about the remedies and solutions in cooperating with the officials of that office, ministry and Inspector general.
One of the suggested remedies is to establish electronic front desks and to facilitate petitions processing through one booth.
In case that the CoI commissioner, the ministry of that office and the Inspector general approve the suggested remedies relating to that office, the work performance monitoring team of Transparency section starts following up and monitoring the performance of that office in order to examine the level of its commitment and to see the progress of the daily performance level. Then submit the final report that includes the success and failure reasons.
2. Financial disclosure directorate:
The main goal of this directorate is focusing on protecting state senior officials (both civilian and military) from corruption, gaining personal benefits, embezzling public funds and from the illicit enrichment through abusing their functions.
To achieve this goal, the directorate prepares a special form to oblige all senior officials and senior military ranks to submit this form annually. They also have to mention their full names, their spouses` names, their children names, their brothers` names, their sisters` names, properties, vehicles, all stocks and policies possessed by him/his family in addition to any amount of money, deposits and jewelry. The persons required to reveal their financial disclosure has to give details about his income or any gifts given to him or to his family.
As soon as the concerned section receives the financial disclosure form, other sections start to investigate, analyze the data and compare them with the previous years` data and finally reach the required results.
The investigation procedure of data authenticity requires several site visits to many institutions and directorates such as banks, financial institutions, traffic police, real estate`s registration, firms` registration and any other office may officials have interests or benefits in.
The main goal behind these procedures is to confirm that the person who holds a senior official position in governmental offices is respecting and performing his duty according to law and patriotic responsibility and never abuse their functions to gain personal benefits. As well as making sure that, he never misappropriates public funds or abuses his administrative function to extort citizens or illicit enrichment that may open wide-open doors for corruption practices inside low ranked employees.
3- Transparency directorate:
The tasks of this directorate concentrate on two important channels: first to ensure the disciplined work performance conducted in governmental offices and in joint sector. The second channel is to monitor performance forms in governmental offices especially in offices received remedies and correction programs within the framework of the Anti-bribery office. The work performance section is in charge of preparing the code of conduct and field education for each governmental official in order to work according the rules and typical performance conditions of their duties under the provision of public service law. As well as the requirements of the code of conduct that the commission established according to the commitments stated by the (UNCAC) which Iraq joined in 2007 and confirmed his obligation in connection with its contexts.
The code of conduct consists of (21) provisions, obligating each state official and the joint sector, to do his/their duty without discrimination among citizens based on gender, nationality, religion belief or any other considerations. The code of conduct is obliging employees to be committed to state provisions, as well as reporting any corruption case or any violation of public service rules or endangering public money. Also, not abusing his/her function to gain personal interests or demanding rewards in return for facilitating petitions and maintaining information confidentiality and the intention to develop his/her work abilities to cooperate with CoI and provide the required information in order to accomplish its mission in fighting corruption.
The second channel is, directed by Transparency
directorate / work performance section, through monitoring site visits and
providing detailed reports about the achievements, negativities, corruption
aspects and make the suggestions to necessary solutions for their ministries
and administrations.
