The criminal court on corruption cases had passed an adversarial proceedings in Baghdad provides for amending the default judgment against the former DG of MOD (Ziad Tariq Abdullaha Al-Qattan), COI Investigation Office revealed.
Concerning the case’s details, the Office pointed out that the convict who occupied more than one post in MOD, he deliberately damaged public money of the party he worked for, explaining his cooperation and connivance with other accused persons for committing breaches of contract between MOD and a company for supplying the ministry with light weapons.
MOD’s legal representative’s statements who request complain against the accused, administrative investigation which included his negligence and reference to the justice as well as BSA’s report included breaches committed by the convict were sufficient to the court to criminalize him pursuant to the article 340 pc, in participation of articles 47, 48 and 49. The judgment included imprisonment and give the right to the affected party to request compensation before civil courts after the decision comes to final.
In April 16, 2018, COI announced operation of extradition for the convict Ziad Al-Qattan from the Jordanian authorities on cases he was wanted, indicated for issuing prison sentence for decades against him, demanding him to return money of about $ 800 million, organizing scores of extradition files against him.
It is recalled that article 247 of Code of Criminal Procedure provides for that when a person sentenced in absentia to death or life or temporary imprisonment is arrested or surrendered to the court or any police office, he shall be tried again and the court may issue a case of any sentence permitted by law and its decision shall be subject to appeal by other legal means.
